Patents

Intellectual property is the process where companies or individuals protect their rights by registering or filing; a patent for a particular invention, copyright with respect to a document (song, book etc), or a trademark.

A patent covers new inventions and protects the way they work, how they are made, the materials involved and there intended use. Once a patent in granted it gives the owner the right to prevent others from making, using or selling their invention without your permission, or paying royalties if agreed.

In order to obtain a patent you would need to process patent filings via the patent office and the cost will vary depending on whether you have your own patent lawyer, the countries you wish to cover with the patent and the complexities of the patent. Searches are required to determine whether similar patents have been filed. The patent office will also investigate whether the product /service falls within the required parameters. The use of a registered patent agents is often essential.

In order for a patent to be granted it must;

- Be a new invention, idea.

- Have an inventive step that is not obvious to an individual without certain product knowledge within the specific area.

- Capable of being made or used in some kind of industry.

Once you have been fortunate enough to get a patent granted then you must renew it year after the 5th year for up to 20 years.
